Cerebral Palsy
Cerebral palsy is a medical condition that affects the ability to control muscle and body movements. It is typically caused by brain damage from lack of oxygen. Cerebral palsy is a serious life changing condition.
Medical Malpractice
Health care professionals are required to provide an acceptable level of care, when a doctor falls below that level of care they have committed medical malpractice. Common types of negligence can include failure to diagnose cancer (or other illnesses) or injury during the birth process that can cause cerebral palsy or other types of birth injury.
A medical malpractice lawsuit requires the injured victim (or the legal representative in a wrongful death case) to prove more likely than not, that the health care provider failed to provide the acceptable level of care, causing injury or death to the victim.
Wrongful Death
Wrongful death is when a victim was killed as a result of negligence or other type of liability. Typically the victim is represented by the surviving family members. Wrongful death claims are extremely emotional cases and require a special type of care. Our firm understands the emotional stress that goes along with these types of cases.
Birth Injury
Birth injuries can be caused by the size of the child, medical complications or even medical negligence. Newborn babies that are larger than average may be at a higher risk for birth injuries. Premature babies are also at a higher risk level of having a birth injury. If the mother has cephalopelvic disproportion the baby may need to be born from a c-section. Failure to recognize certain birth complications could also lead to birth injury. If the child does not receive enough oxygen they may have brain damage and develop cerebral palsy.
